WHAT’S FAIR IN FAIR USE?

In recent years, Fair Use as a basis for allowing the use of footage or music without paying royalties has become more widely accepted by broadcasters, distributors and E&O insurers. But Fair Use is still underutilized and often misunderstood by filmmakers and attorneys alike. In this session, legal experts will put on trial Fair Use examples to illustrate the issues. Moderated by entertainment attorney Dan Satorius.

Panelists include:

Patricia Aufderheide is University Professor in the School of Communication at American University in Washington, D.C. and founder-director of the Center for Social Media. She is the co-author with Peter Jaszi of Reclaiming Fair Use: How to Put Balance Back in Copyright (University of Chicago Press, July 2011), and author of, among others, Documentary: A Very Short Introduction (Oxford, 2007). She heads the Fair Use and Free Speech research project at the Center, in conjunction with Prof. Peter Jaszi in American University’s Washington College of Law.

Dan Satorius (Satorius Law Firm, PC) has spent 25 years representing clients on the independent side of the film and television industry including Academy Award, Emmy Award, Independent Spirit, and Sundance award winners.

Marc H. Simon is an entertainment attorney with Cowan DeBaets Abrahams & Sheppard LLP; and a film director whose credits include Unraveled (playing at DOC NYC) and Nursery University.
